Y recibimos cientos de preguntas sobre las formas de actuar en los procedimientos de compraventa de vivienda.<\/p>\n<p>Vamos a intentar aportar nuestro granito de arena a este asunto.<\/p>\n<p>Como dec\u00edamos en anteriores blogs, el Derecho ante situaciones excepcionales no previstas por las partes en un contrato, permite la posibilidad de modificar las relaciones jur\u00eddicas en base a un cambio de circunstancias que se escapa al control de las partes como es este estado de alarma.<\/p>\n<h3>Y los ejemplos son m\u00e1s ilustrativos que una disertaci\u00f3n jur\u00eddica.<\/h3>\n<p>Dos personas han acordado la firma de un contrato de reserva, un pacto de arras o un contrato de compraventa que ha de cumplirse mientras se ha dictado el estado de alarma sanitaria.<\/p>\n<p>Por un lado, el vendedor tiene unas expectativas l\u00f3gicas para que dichos pagos y el contrato se cumpla y por el otro, el comprador se encuentra ante un cambio de circunstancias personales que le impiden cumplir el contrato en la forma pactada. A veces, si solamente est\u00e1 pendiente la firma de la escritura p\u00fablica, su imposibilidad de cumplir puede no ser de \u00edndole econ\u00f3mica sino de traslado o disponibilidad para acudir a firmar, o bien porque no hay vuelos disponibles o no puede otorgar un poder para comprar al tener los servicios notariales en su pa\u00eds de origen cerrados.<\/p>\n<h3>Ante esto, \u00bfqu\u00e9 propone el derecho?<\/h3>\n<p>De inicio, a las deudas dinerarias, el pago del precio de una compraventa en este caso, no se les aplica autom\u00e1ticamente las causas de fuerza mayor, si bien es claro que hoy en d\u00eda nadie sabe c\u00f3mo la situaci\u00f3n creada influir\u00e1 en las apreciaciones que el derecho, a la hora de aplicarse se van a generar. Es decir, en principio, nada se limita a que un vendedor exija el pago del precio y el cumplimiento del contrato por cuanto si el dinero estaba disponible y la decisi\u00f3n de comprar firmada, habr\u00eda que realizarse. Por otro lado, no es menos cierto que las expectativas de las partes se han frustrado, la del vendedor que ten\u00eda una expectativa de disponer de un dinero y la del comprador, al variar intensamente y sin que sepamos hasta cu\u00e1ndo, su futuro econ\u00f3mico.<\/p>\n<h3>\u00bfC\u00f3mo actuar entonces?<\/h3>\n<p>Desde luego la flexibilidad entre las partes se impone. La m\u00e1s sencilla ser\u00eda que ambas partes acuerden alg\u00fan tipo de modificaci\u00f3n que extienda el plazo del contrato con un pago parcial que permita alargar el mismo hasta que la situaci\u00f3n se aclare. La conservaci\u00f3n de los contratos se impone y parece l\u00f3gico que se difiera en el tiempo su cumplimiento.<\/p>\n<p>Aplicar las condiciones del contrato en forma estricta o exigir su cumplimiento puede ser te\u00f3ricamente posible, pero no es menos cierto que mantener contratos imposibles s\u00f3lo lleva a generar conflictos que complicar\u00edan a\u00fan m\u00e1s las cosas. Los jueces van a ser cuidadosos en este aspecto y van a observar las actitudes de las partes, de tal suerte que tanto el cumplimiento como la aplicaci\u00f3n de cl\u00e1usulas penales ser\u00e1n moderadas por ellos. Tambi\u00e9n es importante valorar que en algunos casos pueden existir abusos en la interpretaci\u00f3n de esas condiciones y habremos de estar atentos a esas actuaciones contrarias a la buena fe.<\/p>\n<p>Por ello, informar de vuestra situaci\u00f3n a la otra parte o proponer soluciones flexibles ser\u00e1n elementos positivos para evitar resoluciones y conflictos que no llevan a nada.<\/p>\n<p>Podemos ayudaros si necesit\u00e1is un consejo general y mandaros gratuitamente modelos para que comuniqu\u00e9is las incidencias. Ya habr\u00e1 tiempo de pelearnos. Adem\u00e1s, hoy por hoy todos pensamos que es algo temporal, si bien no sabemos cu\u00e1nto tiempo ser\u00e1 necesario.
