El asunto se basa en la posibilidad de implantar en suelos r\u00fasticos sin especial protecci\u00f3n ambiental este tipo de actuaciones.<\/p>\n<h2>\u00bfSe debe o se puede hacer Dreamland en Fuerteventura?<\/h2>\n<p>El asunto no es sencillo. En el debate de los medios se plantean cuestiones sobre si en ese sitio se \u201cpuede\u201d implantar una industria de ese tipo o es si se \u201cdebe\u201d instalar ah\u00ed. Muchos matices distorsionan el debate (pol\u00edtica, oportunidad, rapidez de su aprobaci\u00f3n, cercan\u00eda al Parque Natural, el paisaje, inter\u00e9s insular, generaci\u00f3n de empleo,\u2026) y se alejan en cierta medida de un juicio t\u00e9cnico-jur\u00eddico normal. Valores como \u201cel paisaje\u201d, \u201cdesarrollo sostenible\u201d \u201cutilizaci\u00f3n racional\u201d \u201cinter\u00e9s insular\u201d etc\u2026, son indeterminados en cuanto a su significado literal por lo que el juicio de interpretar la norma se complica ya que no hay definiciones comunes a todas las personas sobre estos conceptos. Y como no hay normas t\u00e9cnicas de planeamiento, la incertidumbre es todav\u00eda mayor.<\/p>\n<h2>La indeterminaci\u00f3n de los suelos r\u00fasticos en Canarias<\/h2>\n<p>S\u00ed es cierto que hay suelos reglados, como los urbanos, en los que no deber\u00edan caber interpretaciones sobre qu\u00e9 se puede hacer o no hacer y hay otros, como los r\u00fasticos, en los que, por su naturaleza, se deja la puerta abierta a realizar valoraciones a pesar de estar inicialmente regulados.<\/p>\n<h2>El suelo es un bien escaso en Canarias<\/h2>\n<p>Las islas, tienen de inicio un h\u00e1ndicap que no es otro que la escasez de suelo y por ello es obligatorio que existan normas que aseguren y ordenen todos esos intereses leg\u00edtimos, p\u00fablicos y privados de un modo racional y sostenible.<\/p>\n<p>Y como no se puede proteger todo el suelo ni se puede edificar en todo el suelo como es f\u00e1cil de entender, la norma busca un dif\u00edcil equilibrio entre facilitar la actividad econ\u00f3mica y social y en paralelo, la protecci\u00f3n y conservaci\u00f3n de espacios y suelos valiosos, o bien por sus valores naturales o bien para asegurar la sostenibilidad del desarrollo.<\/p>\n<h2>El Planeamiento y las clases de Suelos<\/h2>\n<p>Ser\u00e1 el Planeamiento insular o municipal que se aprueba por las Administraciones P\u00fablicas, el que, atendiendo a las reglas y principios de las Leyes con incidencia en el territorio, ordene esos suelos y establezca cu\u00e1les ser\u00e1n protegidos y cu\u00e1les podr\u00e1n desarrollarse, en forma inmediata o en un futuro, qu\u00e9 usos podr\u00e1n asignarse y todos los elementos que nos hagan comprender qu\u00e9 es lo que se puede y no se puede hacer.<\/p>\n<p>Los suelos se clasifican en urbanos, urbanizables y r\u00fasticos, que resumidamente se podr\u00edan explicar en los suelos ya transformados en los que la realidad de lo ya ejecutado se impone al planeamiento; los que excepcionalmente se podr\u00e1n transformar en el futuro y los que ser\u00e1n r\u00fasticos y en los que los usos racionales ser\u00e1n limitados atendiendo a los valores de \u00e9stos. Y en esa regulaci\u00f3n, se establecer\u00e1n los derechos y obligaciones de sus propietarios.<\/p>\n<h2>Si uno acude al Planeamiento, en teor\u00eda, podr\u00e1 saber con claridad qu\u00e9 es lo que se puede o no se puede hacer. Parece sencillo \u00bfno?<\/h2>\n<p>Pues tristemente no es as\u00ed de sencillo. Deber\u00eda serlo porque las normas urban\u00edsticas no son un fin en s\u00ed mismas sino que buscan facilitar la comprensi\u00f3n al administrado, pero es claro que no lo han conseguido.<\/p>\n<p>Fuera de las discusiones pol\u00edticas que en muchos casos a\u00f1aden m\u00e1s incomprensi\u00f3n al Urbanismo, la complejidad de las leyes y el planeamiento en Canarias, su falta de claridad, la gran cantidad de ellas, hacen que este conjunto normativo sea confuso y genere dudas o exija un profundo estudio.<\/p>\n<h2>El suelo y el Urbanismo en Fuerteventura exige un conocimiento muy especializado<\/h2>\n<p>Es importante explicar con sencillez y ofrecer una seguridad jur\u00eddica al administrado para que conozca sus derechos y obligaciones y comprenda la regulaci\u00f3n de los suelos.
