El Surf y su masificaci\u00f3n<\/b><\/h2>\n

La definici\u00f3n de Surf que hace Wikipedia es ciertamente simple: <\/span>\u201c<\/span><\/i>El\u00a0<\/span><\/i>surf<\/i><\/b>\u00a0es un\u00a0<\/span><\/i>deporte<\/span><\/i><\/a>\u00a0acu\u00e1tico que consiste en realizar amplios giros y maniobras aprovechando la fuerza de una\u00a0<\/span><\/i>ola<\/span><\/i><\/a>, sobre una\u00a0<\/span><\/i>tabla<\/span><\/i><\/a>\u201d. <\/span>Sin perjuicio de que el surf es un deporte individual, no es menos cierto que hoy en d\u00eda, la masificaci\u00f3n de este deporte hace que su pr\u00e1ctica incide en muchos aspectos que trascienden esa individualidad y que se desarrollan en un espacio en el que muchos practicantes lo realizan al mismo tiempo.<\/span><\/p>\n

En los \u00faltimos a\u00f1os ha aumentado el n\u00famero de surfistas, que en algunos casos se ha masificado y ha generado exponencialmente m\u00e1s conflictos. <\/span>Por ello, a todos no se nos escapa que es necesario un c\u00f3digo de buenas pr\u00e1cticas del surf que ponga un poco de orden a este fen\u00f3meno y que nos oriente sobre las responsabilidades que su pr\u00e1ctica puede generar.<\/span><\/p>\n

El Surf y el Derecho\u00a0<\/b><\/h2>\n

Hasta ahora, no hab\u00eda nada m\u00e1s alejado de la mente de los practicantes del surf que pensar en una serie de regulaciones o normas, por cuanto este deporte est\u00e1 inspirado en la libertad m\u00e1s absoluta y su concepci\u00f3n impide que se encorsete su ejercicio. Pero no es menos cierto que, derivado de esta masificaci\u00f3n en las zonas de surf, los practicantes consideran que es necesario que se impongan algunas reglas de conducta que impidan una anarqu\u00eda absoluta en su pr\u00e1ctica al existir problemas y conflictos con otros surfistas o con usuarios de las playas que parece necesario abordar de una manera coherente.<\/span><\/p>\n

La pregunta es el valor jur\u00eddico de esas reglas de conducta y si ser\u00eda interesante que exista una regulaci\u00f3n oficial que refuerce esas normas.<\/span><\/p>\n

Hoy por hoy, la regulaci\u00f3n legal deriva de mantener las normas que se han otorgado en la organizaci\u00f3n de eventos de surf y llevarlas a la pr\u00e1ctica no competitiva, en una especie de libre asunci\u00f3n de esas reglas en el marco de una competici\u00f3n como modelo de conducta fuera de un evento deportivo.<\/span><\/p>\n

Pero estas reglas no son sencillamente extrapolables a un uso no competitivo, <\/span>no todos somos Kelly Slater<\/span><\/i>, y es complejo que en situaciones de un gran n\u00famero de usuarios sean efectivas.<\/span><\/p>\n

Soft Law y Costumbre<\/b><\/h2>\n

Las reglas de la pr\u00e1ctica del surf est\u00e1n dentro de lo que se denomina \u201c<\/span>Soft Law\u201d, <\/span><\/i>es decir, normas que su contenido est\u00e1n generalmente admitidos pero que carecen de obligatoriedad en su cumplimiento (sanciones, normas publicadas, procedimientos administrativos\u2026) si bien, su incumplimiento si pueda dar lugar a consecuencias jur\u00eddicas. <\/span>Estos C\u00f3digos de Buenas Pr\u00e1cticas del Surf, se han instaurado a lo largo del tiempo por su reiteraci\u00f3n en su pr\u00e1ctica y podr\u00eda considerarse que estamos ante una fuente del derecho como el C\u00f3digo Civil atribuye a la costumbre.\u00a0<\/span><\/p>\n

La costumbre permite considerar a ese c\u00f3digo de buenas pr\u00e1cticas como verdaderas normas jur\u00eddicas, creadas por el grupo social de practicantes que otorgan a una repetici\u00f3n del modelo de conducta con valor de norma. Adem\u00e1s, en el mundo del surf, estas reglas son globales a todas las nacionalidades y de marcado car\u00e1cter internacional. <\/span>Pero este valor de fuente del derecho a la costumbre se relativiza al no poder ir contra la ley, la moral o el orden p\u00fablico, siendo subsidiaria en caso de existencia de una norma expresa y ha de exigirse probarla como \u201checho notorio\u201d que permita basarse en ella ante un conflicto.<\/span><\/p>\n

Normas existentes del surf<\/b><\/h2>\n

Todos los que practicamos este deporte conocemos a grandes rasgos una serie de normas que cubren conceptos como \u201c<\/span>Prioridad\u201d, \u201cSeguridad\u201d \u201cPosici\u00f3n en el pico\u201d \u201cComunicaci\u00f3n con otros surfistas\u201d \u201cEvitar ventajas sobre otros\u201d <\/span><\/i>etc\u2026..<\/span><\/p>\n

Ser\u00eda deseable que este C\u00f3digo de Buenas Pr\u00e1cticas pudiera tener un reflejo en alguna publicaci\u00f3n oficial que evite las debilidades de las normas no escritas y de su posibilidad de acogerse o fundamentar una acci\u00f3n judicial o civil o administrativa en caso de un accidente en el mar entre dos surfistas con resultados de lesi\u00f3n o da\u00f1os a los bienes.<\/span><\/p>\n

Si no existe un c\u00f3digo escrito, el Juez, administraci\u00f3n p\u00fablica, compa\u00f1\u00edas de seguros, que conozcan de un siniestro de surf habr\u00e1n de ser informados del contenido de ese C\u00f3digo de Buenas Pr\u00e1cticas y el mismo habr\u00e1 de serle probado para que en su resoluci\u00f3n se puedan basar en la costumbre aceptada por los usuarios como norma v\u00e1lidamente admitida, en la que su inobservancia en caso de accidentes pueda determinar la responsabilidad al infractor de esa norma y que asuma las consecuencias legales de sus actos.<\/span><\/p>\n

Respect & Enjoy<\/b><\/h2>\n
