Eso dice nuestro C\u00f3digo Civil. Si bien es cierto que este derecho no ha de verse desde la exclusiva consideraci\u00f3n del titular de la propiedad sino de su funci\u00f3n social que m\u00e1s que un l\u00edmite de la propiedad es parte integrante del derecho. Lo que aclara la Constituci\u00f3n.<\/p>\n<p>En el mundo inmobiliario espa\u00f1ol, hemos sido muy poco innovadores en relaci\u00f3n a la propiedad. Seguimos con la misma idea desde Roma. O somos propietarios en el 100% de todo, el pleno dominio que implica ser propietario de todo hasta el cielo y hasta el infierno de una propiedad, o no nos gusta. Somos propietarios por naturaleza y nos gustan que las cosas sean nuestras.<\/p>\n<p>Los que nos visitan aportan otras formas de vincularse con una propiedad y estamos escuchando ideas de expertos que proponen algunas ideas para solucionar un problema actual que es la falta de vivienda y por el otro lado, formas de evitar que se consuma mucho suelo y cada propiedad solamente pertenezca a una persona.<\/p>\n<h2><strong>Propiedad en fracciones.<\/strong><\/h2>\n<p>Existen empresas que est\u00e1n apostando por vender fracciones de una propiedad, preferentemente segunda residencia, lo que especialmente nos podr\u00eda interesar en la isla de Fuerteventura, en la que si bien adquieres la propiedad, lo haces en un porcentaje entre un 15-35% que te asigna un uso exclusivo y excluyente de la vivienda sobre el resto de los copropietarios. Un algoritmo regula los usos asignados y el tiempo de uso, con una cobertura legal que hemos podido estudiar es excelente y viene avalada por los grandes despachos de prestigio en Espa\u00f1a. Eso puede evitar por un lado, que las viviendas que adquieren los no residentes no se queden vac\u00edas y por otro lado, que quienes compren una fracci\u00f3n van a disfrutarla ellos mismos y no turistas, con lo que cierta tensi\u00f3n en la capacidad de carga tur\u00edstica y la existencia de viviendas vacacionales puede ser rebajada.<\/p>\n<h2><strong>El derecho de superficie.<\/strong><\/h2>\n<p>Por el otro lado, existe mucho suelo que no se desarrolla y queda en barbecho inmobiliario. Muchos propietarios no quieren desprenderse del mismo a bajo precio y otros no lo quieren comprar caro. Y hay mucho suelo p\u00fablico. Y en estos casos, el derecho de superficie puede solucionar muchos problemas, ya sea al comprador final o a promotores que les pueda interesar construir para alquilar que ven que no han de asumir un coste importante en la adquisici\u00f3n del suelo. Este derecho, a modo de Leasehold del mundo anglosaj\u00f3n, permite que la persona sea propietaria durante un tiempo, transcurrido el mismo, lo edificado vuelve a la propiedad del titular del suelo.
