LAJARES LAW OFFICES quiere realizar una serie de manifestaciones ante las numerosas consultas recibidas por la presentaci\u00f3n del Anteproyecto de Ley de Ordenaci\u00f3n del Uso Tur\u00edstico de Viviendas y la preocupaci\u00f3n social existente.<\/p>\n

 <\/p>\n

No es una Ley, es un proyecto. Sigue vigente el marco legal vigente para las viviendas vacacionales.<\/strong><\/p>\n

LAJARES LAW OFFICES se\u00f1ala que la propuesta de ley no es una Ley y que por tanto sigue vigente el anterior marco normativo y la posibilidad de presentar las declaraciones responsables para obtener una licencia vacacional. S\u00ed, siempre puede solicitar una licencia de alquiler vacacional de acuerdo con la normativa vigente.<\/p>\n

\u00a0<\/strong><\/p>\n

LAJARES LAW OFFICES est\u00e1 comprometido con las viviendas vacacionales.<\/strong><\/p>\n

LAJARES LAW OFFICES est\u00e1 estudiando con mucho inter\u00e9s la propuesta\/borrador de la Ley que afectar\u00e1 a las viviendas vacacionales y har\u00e1 sus alegaciones.<\/p>\n

 <\/p>\n

El anteproyecto tendr\u00eda un potencial impacto negativo para las viviendas vacacionales.<\/strong><\/p>\n

LAJARES LAW OFFICES considera que su impacto en el mercado inmobiliario, la actividad econ\u00f3mica, el turismo y en general en el Norte de la Isla puede ser importante si no se modifican algunos de sus aspectos.<\/p>\n

\u00a0<\/strong><\/p>\n

No era la norma esperada sobre viviendas vacacionales.<\/strong><\/p>\n

LAJARES LAW OFFICES considera que algunas de las expectativas, motivos y que se dieron a los ciudadanos en el primer proceso de informaci\u00f3n p\u00fablica en Noviembre de 2023 no se han cumplido y\/o han sido incluso m\u00e1s negativas.<\/p>\n

\u00a0<\/strong><\/p>\n

Es una propuesta de norma de dif\u00edcil comprensi\u00f3n sobre viviendas vacacionales.<\/strong><\/p>\n

LAJARES LAW OFFICES considera que la Ley es extraordinariamente extensa en su exposici\u00f3n de motivos (34 p\u00e1ginas), los art\u00edculos son igualmente extensos y en general, no es una norma que permita ser comprendida f\u00e1cilmente por el verdadero destinatario de la norma, el ciudadano. Esto podr\u00eda ir en contra de la simplificaci\u00f3n y la racionalizaci\u00f3n del marco normativo.<\/p>\n

 <\/p>\n

La falta de vivienda residencial no puede imputarse \u00fanicamente a las viviendas vacacionales.<\/strong><\/p>\n

LAJARES LAW OFFICES no comparte la fundamentaci\u00f3n de la norma que se basa esencialmente en relacionar la ausencia de vivienda residencial libre y el derecho a un acceso a una vivienda digna y adecuada con la existencia de viviendas vacacionales, en un ejercicio excesivamente simplista de causa-efecto.<\/p>\n

Sin perjuicio de sus limitados efectos, son otras normas sobre vivienda las que han de regular las ausencias de viviendas en Canarias como ya se est\u00e1 realizando. Entendemos que las normas dictadas por el propio Gobierno de Canarias en materia de vivienda (https:\/\/www.gobiernodecanarias.org\/boc\/2024\/037\/001.html<\/a>) han de ir coordinadas, por cuanto si son exitosas las medidas sobre el acceso a la vivienda propuestas, decae gran parte de la justificaci\u00f3n de la norma sobre viviendas vacacionales.<\/p>\n

\u00a0<\/strong><\/p>\n

La propuesta no puede hacerse desde la prohibici\u00f3n y un excesivo intervencionismo a las viviendas vacacionales.<\/strong><\/p>\n

LAJARES LAW OFFICES considera que la regulaci\u00f3n de las viviendas vacacionales y su fundamentaci\u00f3n se ha de hacer motivada en la comparaci\u00f3n con otros productos tur\u00edsticos, en establecer criterios de implantaci\u00f3n que impidan pr\u00e1cticas negativas, todo ello a los efectos de que se apliquen similares requisitos de calidad, servicios y otros a los efectos de mejorar la oferta tur\u00edstica en Canarias, si bien no consta esta cuesti\u00f3n como motivo esencial de la norma.<\/p>\n

\u00a0<\/strong><\/p>\n

Ciertas propuestas suponen la expulsi\u00f3n de muchas viviendas vacacionales del mercado.<\/strong><\/p>\n

LAJARES LAW OFFICES observa ciertas contradicciones en su norma, ya que si como se reconoce en La Oliva hay un 21,50% de Vivienda Vacacional en comparaci\u00f3n con la de uso residencial, el imponer que el planeamiento s\u00f3lo pueda admitir un 10% de la edificaci\u00f3n residencial destinada a este producto, supondr\u00eda la declaraci\u00f3n de fuera de ordenaci\u00f3n de ese porcentaje que se conoce como superior al previsto por la norma. Creemos que la realidad es la que es, y s\u00f3lo una y ning\u00fan sentido tiene esta limitaci\u00f3n.<\/p>\n

Otra cuesti\u00f3n es saber si la vivienda vacacional, una vez autorizada, es un producto tur\u00edstico y no residencial, con las contradicciones legales y de fondo que eso implica.<\/p>\n

\u00a0<\/strong><\/p>\n

S\u00f3lo podr\u00e1n ser destinadas a vivienda vacacional las viviendas con m\u00e1s de 10 a\u00f1os y que carecen de los criterios de eficiencia y sostenibilidad actuales. <\/strong><\/p>\n

LAJARES LAW OFFICES entiende que, si como se\u00f1ala la propuesta, se busca que al mercado de la Vivienda Vacacional s\u00f3lo accedan viviendas de m\u00e1s de 10 a\u00f1os de antig\u00fcedad, parece inicialmente contradictorio con mantener un parque de viviendas vacacionales eficientes y modernas. Como quiera que entre el periodo de 2007-2014 se construyeron muy pocas viviendas en Canarias por la crisis econ\u00f3mica, esta menci\u00f3n obligar\u00eda casi a que al mercado de Vivienda Vacacional s\u00f3lo accedan aquellas de m\u00e1s de 17 a\u00f1os, que en muchos casos no cumplen los m\u00ednimos requisitos del actual C\u00f3digo T\u00e9cnico de Edificaci\u00f3n en materia como sostenibilidad, eficiencia y dem\u00e1s.<\/p>\n
