Es el instrumento legal que, tras analizar la situaci\u00f3n de una zona concreta, de nuestro medio rural y de nuestra forma de vida, afronta los retos del futuro mediante las t\u00e9cnicas urban\u00edsticas adecuadas.<\/p>\n<h3><strong>\u00bfCu\u00e1l es el impacto del Plan General de Ordenaci\u00f3n sobre mis derechos de propiedad?<\/strong><\/h3>\n<p>Los instrumentos de planeamiento urban\u00edstico predeterminan, en cierto modo, el estatuto del derecho de propiedad. Lo limitan y condicionan por esa intervenci\u00f3n p\u00fablica a la hora de determinar el r\u00e9gimen jur\u00eddico del suelo.<\/p>\n<p>Sencillamente, uno puede ser propietario de la m\u00e1s maravillosa de las fincas inimaginables en Fuerteventura y entiendes que en ese terreno puedes realizar una serie de acciones que dar\u00edan valor a tu propiedad como, implantar un camino de acceso de permita segregar y hacer varias casas o edificar un surf-camp o hacerte un Ch\u00e2teau, vamos, cualquier idea que pretendas.<\/p>\n<p>Igualmente, tienes el apartamento m\u00e1s maravilloso del mundo en Fuerteventura, y deseas hacer algunos cambios, cerrar la terraza, ampliaciones, cambios de usos, ponerlo en alquiler vacacional\u2026. O un local comercial o cualquier bien inmueble.<\/p>\n<p>Todos lo pensamos y hacemos\u2026, algunos sin pensar en las consecuencias.<\/p>\n<p>Pues no, ese derecho de propiedad est\u00e1 limitado y condicionado a un planeamiento urban\u00edstico que regula lo que puedes hacer y lo que no puedes hacer, y por tanto tus ideas sobre el mismo no valen nada si el planeamiento urban\u00edstico no le da cobertura.<\/p>\n<p>La vinculaci\u00f3n entre esas dos ramas de Derecho es esencial para comprender los derechos que adquirimos cuando compramos o invertimos en una propiedad y es necesario asesorarse con un profesional.<\/p>\n<h3><strong>\u00bfSab\u00eda que cada comunidad aut\u00f3noma espa\u00f1ola tiene su propia normativa urban\u00edstica?<\/strong><\/h3>\n<p>Lo que ocurre en Espa\u00f1a, y en concreto en Canarias, es que cada comunidad aut\u00f3noma espa\u00f1ola tiene su propia normativa urban\u00edstica.\u00a0 Y eso es un mont\u00f3n de leyes que se complican tanto que es dif\u00edcil entender un tema complejo. En muchas ocasiones, las normas se contradicen o se aplican err\u00f3neamente y deben ser aclaradas o interpretadas por un tribunal para poder aplicarlas.<\/p>\n<p>Adem\u00e1s, cada isla y municipio tiene su propio planeamiento urban\u00edstico que regula aspectos que condicionan el derecho de propiedad. Y cada isla\/municipio los interpreta o dispone de m\u00e1s o menos recursos para atender las necesidades de los ciudadanos. Unos t\u00e9cnicos insulares\/municipales consideran una cosa y otros otra, porque el derecho urban\u00edstico es una materia muy interpretable.<\/p>\n<p>De vez en cuando, en la isla de Fuerteventura, la normativa urban\u00edstica se actualiza. Se pueden crear nuevas normas, adaptadas a las nuevas leyes y a la nueva realidad social.<\/p>\n<h3><strong>El Ayuntamiento de La Oliva anuncia la redacci\u00f3n de un nuevo Plan General de Ordenaci\u00f3n (PGO).<\/strong><\/h3>\n<p>Recientemente el Ayuntamiento de La Oliva ha aprobado en Junta de Gobierno el encargo para la redacci\u00f3n del tan esperado Plan General de Ordenaci\u00f3n (PGO). Tras d\u00e9cadas funcionando bajo las limitaciones de las Normas Subsidiarias de 2000 , La Oliva se embarca en la elaboraci\u00f3n de un PGO que promover\u00e1 un desarrollo urban\u00edstico m\u00e1s ordenado y sostenible en el municipio.<\/p>\n<p>El nuevo Plan General de Ordenaci\u00f3n de La Oliva pretende actualizar y mejorar la ordenaci\u00f3n territorial del municipio, incorporando criterios de sostenibilidad y transici\u00f3n ecol\u00f3gica.
