Nous avons re\u00e7u \u00e9norm\u00e9ment de questions concernant l\u2019impact sur les proc\u00e9dures d&rsquo;achat et de vente de maisons.<\/p>\n<p align=\"JUSTIFY\">Nous essaierons de clarifier les th\u00e8mes les plus courants.<\/p>\n<p align=\"JUSTIFY\">\n<h3 class=\"western\" align=\"JUSTIFY\"><a name=\"_5mqw5gpady2q\"><\/a> Comme nous l&rsquo;avons expliqu\u00e9 dans les blogs pr\u00e9c\u00e9dents, la loi, dans des situations exceptionnelles non pr\u00e9vues par les parties dans leur contrat, permet aux parties de modifier leur contrat en raison de situations impr\u00e9vues et ind\u00e9pendantes de la volont\u00e9 des parties, comme cet \u00e9tat d&rsquo;urgence impos\u00e9 par le Gouvernement.<\/h3>\n<p align=\"JUSTIFY\">Un exemple.<\/p>\n<p align=\"JUSTIFY\">Deux personnes ont accept\u00e9 de signer un contrat de r\u00e9servation, un accord de d\u00e9p\u00f4t ou un contrat d&rsquo;achat ou de vente \u00e0 ex\u00e9cuter pendant cet \u00e9tat d\u2019urgence impos\u00e9 par le Gouvernement.<\/p>\n<p align=\"JUSTIFY\">D&rsquo;une part, le vendeur a des attentes logiques et compr\u00e9h\u00e9nsibles pour que les paiements et le contrat soient ex\u00e9cut\u00e9s. D&rsquo;autre part, l&rsquo;acheteur est confront\u00e9 \u00e0 un changement de circonstances qui l&#8217;emp\u00eache d&rsquo;ex\u00e9cuter le contrat sous la forme convenue.<\/p>\n<p align=\"JUSTIFY\">Non seulement des aspects \u00e9conomiques, mais aussi des \u00e9l\u00e9ments logistiques peuvent entra\u00eener l&rsquo;impossibilit\u00e9 de respecter les accords juridiques : dans le cas o\u00f9 seule la signa<span style=\"color: #000000;\">ture de l\u2019acte public est en attente, alors qu&rsquo;il n&rsquo;y a pas de vols disponibles et qu&rsquo;il est impossible de<\/span> <span style=\"color: #000000;\">donner une procuration<\/span> car les services notariaux sont suspendus dans votre pays d&rsquo;origine, comment proc\u00e9der ?<\/p>\n<h3 class=\"western\" align=\"JUSTIFY\"><a name=\"_ho4q2zfzifml\"><\/a> Que propose la loi dans cette situation?<\/h3>\n<p align=\"JUSTIFY\">Initialement, pour les dettes mon\u00e9taires, le paiement du prix de vente, les causes de force majeure ne sont pas automatiquement appliqu\u00e9es. Bien qu&rsquo;il soit clair qu&rsquo;aujourd&rsquo;hui personne ne sait comment la situation influencera les appr\u00e9ciations de la loi, ni quand elle <span style=\"color: #000000;\">pourra \u00eatre<\/span> appliqu\u00e9e.<\/p>\n<p align=\"JUSTIFY\">En d&rsquo;autres termes, en principe, rien n&#8217;emp\u00eache au vendeur d\u2019exiger le paiement du prix de vente et de l&rsquo;ex\u00e9cution du contrat En effet, si l&rsquo;argent \u00e9tait disponible et la d\u00e9cision d&rsquo;achat sign\u00e9e, celui-ci serait d\u00e9j\u00e0 act\u00e9.<\/p>\n<p align=\"JUSTIFY\">Rien n&rsquo;est plus vrai que de dire que les attentes des deux parties sont affect\u00e9es. Le vendeur, qui s&rsquo;attendait \u00e0 recevoir une somme d&rsquo;argent, mais aussi l&rsquo;acheteur, dans une plus ou moins grande mesure et sans savoir pendant combien de temps, doivent faire face aux cons\u00e9quences d&rsquo;un avenir \u00e9conomique incertain.<\/p>\n<h3 class=\"western\" align=\"JUSTIFY\"><a name=\"_jvknrufzrbyh\"><\/a> Comment r\u00e9agir?<\/h3>\n<p align=\"JUSTIFY\">Bien s\u00fbr, la flexibilit\u00e9 entre les parties est indispensable. Le plus simple serait que les deux parties acceptent un type de modification qui prolonge la dur\u00e9e du contrat, avec un paiement partiel qui permet de le prolonger jusqu&rsquo;\u00e0 ce que la situation soit clarifi\u00e9e.<\/p>\n<p align=\"JUSTIFY\">Il est th\u00e9oriquement possible d&rsquo;appliquer strictement les conditions du contrat ou d&rsquo;exiger son ex\u00e9cution, mais il n&rsquo;en est pas moins vrai que le maintien de contrats impossibles ne m\u00e8ne qu&rsquo;\u00e0 des conflits qui compliqueraient encore les choses. Les juges seront attentifs \u00e0 cet \u00e9gard et observeront l&rsquo;attitude des parties, et leur aptitude \u00e0 respecter et \u00e0 mod\u00e9rer l&rsquo;application des clauses p\u00e9nales.
