Que signifie le <\/strong>g\u00e9or\u00e9f\u00e9rencement ? Mon bien peut \u00ab\u00a0bouger ?<\/strong><\/h2>\n

Le g\u00e9or\u00e9f\u00e9rencement et l’enregistrement des g\u00e9odonn\u00e9es visent \u00e0 d\u00e9limiter pr\u00e9cis\u00e9ment la propri\u00e9t\u00e9 enregistr\u00e9e, afin d’accro\u00eetre la s\u00e9curit\u00e9 juridique et de r\u00e9duire les co\u00fbts \u00e9conomiques. En d’autres termes, l’objectif est de localiser un point pr\u00e9cis sur la surface de la terre \u00e0 l’aide des coordonn\u00e9es de la carte et, gr\u00e2ce \u00e0 cette mesure et \u00e0 cette identification, de l’incorporer au registre foncier.<\/p>\n

Nous avons vu plusieurs cas dont des propri\u00e9t\u00e9s, par nature inamovibles, \u00ab\u00a0bougent\u00a0\u00bb sur le plan cadastral, comme par magie, d’un c\u00f4t\u00e9 ou de l’autre, modifiant les limites, les superficies et d’autres \u00e9l\u00e9ments suppos\u00e9s fixes.<\/p>\n

Dans de nombreux cas, les limites d’une propri\u00e9t\u00e9 sont g\u00e9n\u00e9ralement des murs visibles \u00e0 l’\u0153il nu, mais dans le registre foncier, elles sont d\u00e9plac\u00e9es et ne correspondent pas \u00e0 la r\u00e9alit\u00e9. Mais, bien s\u00fbr, il existe aussi des propri\u00e9t\u00e9s sans murs, ce qui rendra beaucoup plus difficile l’interpr\u00e9tation des limites de notre propri\u00e9t\u00e9 et nous vous serions reconnaissants de disposer de coordonn\u00e9es pour marquer cette limite, car cela peut \u00eatre une source de conflit.<\/p>\n

Pour donner un exemple, imaginons que nous achetions une propri\u00e9t\u00e9 dont nous voyons les murs bien d\u00e9finis, un jardin spacieux et apparemment tout est bien rang\u00e9. Il s’av\u00e8re que le voisin d’\u00e0 c\u00f4t\u00e9 a proc\u00e9d\u00e9 \u00e0 l’enregistrement des g\u00e9odonn\u00e9es de sa propri\u00e9t\u00e9 et lorsque nous le faisons, nous constatons qu’elle mange \u00ab\u00a0th\u00e9oriquement\u00a0\u00bb la moiti\u00e9 de notre jardin. Comme notre parcelle n’est pas g\u00e9or\u00e9f\u00e9renc\u00e9e nous n\u2019aurions aucun argument juridique pour la d\u00e9fendre, alors que si nous avions enregistr\u00e9 les g\u00e9odonn\u00e9es de notre propri\u00e9t\u00e9, nous aurions la garantie que cette moiti\u00e9 du jardin nous appartient.<\/p>\n

Un autre exemple simple serait le suivant : nous commen\u00e7ons notre projet sur une propri\u00e9t\u00e9 qui n’est pas g\u00e9or\u00e9f\u00e9renc\u00e9e et sans limites claires. C’est-\u00e0-dire sans murs ni limites apparentes, indiquant que les limites sont n’importe quelles limites. Nous commen\u00e7ons \u00e0 construire sur ce terrain conform\u00e9ment \u00e0 l’ordonnance en vigueur, en respectant les param\u00e8tres \u00e9tablis et en investissant de l’argent et du temps dans cette esquisse en pensant que tout se d\u00e9roule correctement. Mais le voisin pr\u00e9tend que notre limite n’est pas l\u00e0 o\u00f9 nous pensions qu’elle \u00e9tait ; qu’elle se situe quelques m\u00e8tres plus loin et que ces m\u00e8tres de terrain sur lesquels nous comptions sont les siens. Si les g\u00e9odonn\u00e9es de notre propri\u00e9t\u00e9 ne sont enregistr\u00e9es aupr\u00e8s du registre foncier, et que celle du voisin l’est, nous pourrions \u00eatre contraints de d\u00e9molir l’ensemble du projet et perdre tout ce que nous avons fait jusque-l\u00e0, malheureusement. Si, en revanche, le g\u00e9or\u00e9f\u00e9rencement a \u00e9t\u00e9 effectu\u00e9s et a \u00e9t\u00e9 enregistr\u00e9 sur cette propri\u00e9t\u00e9, nous pourrons dire au voisin que la limite de la propri\u00e9t\u00e9 est enregistr\u00e9e et consign\u00e9e et que le terrain est enregistr\u00e9 comme \u00e9tant le n\u00f4tre. Nous allons donc poursuivre le projet et nous pourrons recommander au voisin le g\u00e9or\u00e9f\u00e9rencement ou la recherche d’un bon avocat. Il va \u00eatre tr\u00e8s difficile pour lui de gagner ou de s’approprier ces terres.<\/p>\n

Quelles sont les avantages du g\u00e9or\u00e9f\u00e9recement?<\/strong><\/h2>\n

LES TITRES DE PROPRI\u00c9T\u00c9 N’AIDENT PAS et LE CATASTRE ne nous aide pas. NOUS VOULONS \u00caTRE CERTAINS DE CE QUE NOUS POSS\u00c9DONS.<\/strong><\/p>\n

De plus en plus de conflits surgissent entre voisins \u00e0 propos de la portion de terrain qui appartient \u00e0 chacun d’entre eux. Et il est tr\u00e8s difficile, compte tenu de la description litt\u00e9rale figurant dans les titres de propri\u00e9t\u00e9, de savoir exactement o\u00f9 se trouvent vos limites.<\/p>\n

\u00c0 cela s’ajoute le probl\u00e8me que le Cadastre, mentionn\u00e9 ci-dessus, qui est un registre administratif comprenant des plans, refl\u00e8te dans de nombreux cas des propri\u00e9t\u00e9s dont les d\u00e9limitations ne correspondent pas du tout \u00e0 la r\u00e9alit\u00e9.<\/p>\n

Pour ainsi dire, le mur que vous voyez par votre fen\u00eatre et qui d\u00e9limite votre parcelle n’est probablement pas repr\u00e9sent\u00e9 dans la position o\u00f9 il se trouve sur le plan cadastral et est d\u00e9plac\u00e9.<\/p>\n
