Il s’agit d’une proposition de r\u00e8glement sur les r\u00e9sidences secondaires difficile \u00e0 comprendre.<\/strong><\/p>\n

LAJARES LAW OFFICES consid\u00e8re que la loi est extraordinairement longue dans son expos\u00e9 des motifs (34 pages), que les articles sont tout aussi longs et qu’en g\u00e9n\u00e9ral, ce n’est pas une loi qui peut \u00eatre facilement comprise par le v\u00e9ritable destinataire de la loi, le citoyen. Cela pourrait aller \u00e0 l’encontre de la simplification et de la rationalisation du cadre r\u00e9glementaire.<\/p>\n

Le manque de logements r\u00e9sidentiels ne peut pas \u00eatre attribu\u00e9 uniquement aux r\u00e9sidences secondaires.<\/strong><\/p>\n

LAJARES LAW OFFICES n’est pas d’accord avec le raisonnement du r\u00e8glement, qui repose essentiellement sur l’\u00e9tablissement d’un lien entre le manque de logements r\u00e9sidentiels libres et le droit d’acc\u00e8s \u00e0 un logement d\u00e9cent et ad\u00e9quat et l’existence de r\u00e9sidences secondaires, dans un exercice de cause \u00e0 effet excessivement simpliste.<\/p>\n

Sans pr\u00e9judice de ses effets limit\u00e9s, ce sont d’autres r\u00e9glementations en mati\u00e8re de logement qui doivent r\u00e9guler le manque de logements aux \u00eeles Canaries, comme c’est d\u00e9j\u00e0 le cas. Nous pensons qu’il faut coordonner les r\u00e9glementations en mati\u00e8re de logement \u00e9mises par le gouvernement des \u00eeles Canaries lui-m\u00eame https:\/\/www.gobiernodecanarias.org\/boc\/2024\/037\/001.html<\/a>, car si les mesures propos\u00e9es en mati\u00e8re d’acc\u00e8s au logement sont couronn\u00e9es de succ\u00e8s, une grande partie de la justification de la r\u00e9glementation des r\u00e9sidences secondaires est perdue.<\/p>\n

La proposition ne peut \u00eatre faite sur la base d’une interdiction et d’un interventionnisme excessif dans le domaine des r\u00e9sidences secondaires.<\/strong><\/p>\n

LAJARES LAW OFFICES consid\u00e8re que la r\u00e9glementation des r\u00e9sidences secondaires et sa justification doivent se fonder sur la comparaison avec d’autres produits touristiques, sur l’\u00e9tablissement de crit\u00e8res d’application qui emp\u00eachent les pratiques n\u00e9gatives, tout cela dans le but d’appliquer des exigences similaires en mati\u00e8re de qualit\u00e9, de services et autres, afin d’am\u00e9liorer l’offre touristique dans les \u00eeles Canaries, bien que cette question ne soit pas mentionn\u00e9e comme une raison essentielle de la r\u00e9glementation.<\/p>\n

Certaines propositions conduiraient \u00e0 l’expulsion du march\u00e9 de nombreux logements de vacances.<\/strong><\/p>\n

LAJARES LAW OFFICES observe certaines contradictions dans son r\u00e8glement, car si, comme on le reconna\u00eet \u00e0 La Oliva, il y a 21,50 % de maisons de vacances par rapport \u00e0 l’usage r\u00e9sidentiel, imposer que la planification ne puisse admettre que 10 % de l’immeuble r\u00e9sidentiel destin\u00e9 \u00e0 ce produit, reviendrait \u00e0 d\u00e9clarer que ce pourcentage, dont on sait qu’il est sup\u00e9rieur \u00e0 celui pr\u00e9vu par le r\u00e8glement, n’est pas conforme \u00e0 la r\u00e9glementation.
