Le projet de loi pour la gestion durable de l’utilisation touristique des logements dans les \u00eeles Canaries \u00e9tablit un \u00ab conflit \u00bb entre les logements r\u00e9sidentiels permanents et les r\u00e9sidences secondaires.<\/span><\/p>\n

Dans la r\u00e9alit\u00e9 sociale du r\u00e8glement et lorsqu’il s’agit de justifier les raisons de son approbation, que ce soit dans le texte lui-m\u00eame ou dans les d\u00e9clarations aux m\u00e9dias, il n’y a que des logements qui servent de r\u00e9sidence permanente et de r\u00e9sidence de vacances, oubliant qu’il y a des logements qui, remplissant les conditions pour \u00eatre d\u00e9finis comme tels, ont \u00e9t\u00e9 promus, acquis ou utilis\u00e9s comme r\u00e9sidences secondaires par leurs propri\u00e9taires.<\/p>\n

Nous pensons que ce type de propri\u00e9t\u00e9 (r\u00e9sidence secondaire) existe dans le parc immobilier des \u00eeles Canaries, qui n’a en aucun cas \u00e9t\u00e9 con\u00e7u \u00e0 l’origine pour servir de r\u00e9sidence permanente \u00e0 son propri\u00e9taire, mais plut\u00f4t pour servir \u00e0 ses loisirs ou \u00e0 ceux de ses amis, ou m\u00eame pour \u00eatre lou\u00e9 pour la saison. C’est ainsi que de nombreux lotissements r\u00e9partis sur l’ensemble de l’\u00eele, des immeubles, des complexes et des maisons individuelles sont d\u00e9tenus par de nombreux Canariens, Majoreros et \u00e9trangers dans ce but.<\/p>\n

Pr\u00e9tendre que cette r\u00e9alit\u00e9 et cette utilisation consolid\u00e9e des r\u00e9sidences secondaires ou des \u00ab maisons sur la c\u00f4te \u00bb dans la soci\u00e9t\u00e9 sont inexistantes et sans importance exigerait un impossible exercice d’aveuglement, \u00e9tant donn\u00e9 que de nombreux b\u00e2timents de ce type ont \u00e9t\u00e9 con\u00e7us, achet\u00e9s et utilis\u00e9s de mani\u00e8re consolid\u00e9e au fil du temps.<\/span><\/p>\n

Leur existence en tant que r\u00e9alit\u00e9 est confirm\u00e9e par l’Agence fiscale lorsqu’elle les d\u00e9finit, par l’INE lorsqu’elle les \u00e9tudie et est mentionn\u00e9e dans la loi canarienne sur le logement.<\/span><\/p>\n

Par cons\u00e9quent, il est clairement n\u00e9cessaire d’inclure des donn\u00e9es sur les r\u00e9sidences secondaires dans le d\u00e9bat, car elles constituent une partie importante de la r\u00e9alit\u00e9 que la loi est cens\u00e9e r\u00e9glementer et qui doit \u00eatre prise en compte. Sans cela, l’image de la r\u00e9alit\u00e9 sociale prise par la r\u00e9glementation sera incertaine et sa r\u00e9glementation sera affaiblie.<\/span><\/p>\n

Nous partons du principe que si une r\u00e9sidence secondaire n’a jamais \u00e9t\u00e9 destin\u00e9e \u00e0 servir de r\u00e9sidence permanente, elle ne devrait pas g\u00e9n\u00e9rer de conflit avec les habitations r\u00e9sidentielles et le droit d’acc\u00e8s \u00e0 un logement d\u00e9cent, car les logements destin\u00e9s \u00e0 \u00eatre des r\u00e9sidences permanentes et qui sont transform\u00e9s en r\u00e9sidences de vacances ne devraient pas \u00eatre retir\u00e9s du march\u00e9.<\/span><\/p>\n
