Lajares Law Offices a particip\u00e9 \u00e0 une conf\u00e9rence organis\u00e9e par l’Association des Conseillers Fiscaux des Iles Canaries et y a revu certaines donn\u00e9es d’une \u00e9tude que l’Association des \u00c9conomistes de Las Palmas de Gran Canaria a r\u00e9alis\u00e9e sur les r\u00e9sidences secondaires. L’ouvrage s’intitule \u00ab El turismo de Canarias, un multimodelo a revisi\u00f3n <\/em>\u00bb, dirig\u00e9 par Rosa Rodr\u00edguez D\u00edez.<\/p>\n

Selon cette \u00e9tude, les donn\u00e9es utilis\u00e9es par le gouvernement des \u00eeles Canaries pour justifier le projet de loi sur les logements de vacances sont erron\u00e9es et doivent \u00eatre consid\u00e9rablement affin\u00e9es<\/u>, concluant que le probl\u00e8me des logements de vacances varie consid\u00e9rablement d’une municipalit\u00e9 \u00e0 l’autre et que les conclusions tir\u00e9es des donn\u00e9es sont erron\u00e9es. Nous sommes confront\u00e9s \u00e0 une lutte de donn\u00e9es, mais il est surprenant qu’\u00e0 partir des \u00ab m\u00eames \u00bb donn\u00e9es, on parvienne \u00e0 des conclusions ou \u00e0 des positions aussi diff\u00e9rentes.<\/p>\n

Ce que l’on peut retenir de cette \u00e9tude, c’est la conclusion ou la pr\u00e9misse suivante sur un fait qui ne semble pas contradictoire. Si une grande partie des r\u00e9sidences secondaires se trouvent dans des zones touristiques, c’est-\u00e0-dire des zones o\u00f9 la planification veut que les touristes soient s\u00e9par\u00e9s des r\u00e9sidents, article 3 c) de la loi 2\/213 sur la modernisation du tourisme dans les \u00eeles Canaries \u00ab Pour \u00e9viter et, le cas \u00e9ch\u00e9ant, r\u00e9orienter la r\u00e9sidentialisation des zones touristiques \u00bb, il ne semble pas logique de fixer des limites \u00e0 l’implantation de r\u00e9sidences secondaires dans ces zones si la r\u00e9glementation ne veut pas d’habitations r\u00e9sidentielles permanentes dans ces zones.<\/u><\/p>\n

Es l\u00f3gico pensar que en esa zona tur\u00edstica no existe el conflicto por la falta de vivienda residencial permanente con el derecho a una vivienda digna, por cuanto la norma no quiere, manifestado expresamente y en todas las leyes tur\u00edsticas y de ordenaci\u00f3n del territorio, que la gente resida en dicha zona junto con los turistas.<\/p>\n

Cependant, par un retournement de situation ou un changement de position assez radical, le gouvernement consid\u00e8re d\u00e9sormais que les travailleurs doivent vivre \u00e0 proximit\u00e9 de leur lieu de travail et ne pas avoir \u00e0 parcourir de longues distances pour des raisons d’\u00e9missions et autres, et semble implicitement rechercher la r\u00e9sidentialisation des zones touristiques. Cela semble contredire ce qui est clairement indiqu\u00e9 dans le r\u00e8glement et par le l\u00e9gislateur canarien au sujet des zones touristiques et de la volont\u00e9 d’\u00e9viter la r\u00e9sidentialisation dans ces zones. Il serait bon qu’ils nous \u00e9clairent \u00e0 ce sujet.<\/p>\n

Et ceci est en accord avec la pr\u00e9misse que nous avons mentionn\u00e9e dans le premier blog sur les r\u00e9sidences secondaires et de vacances, o\u00f9 nous avons averti que dans la plupart des municipalit\u00e9s canariennes, en particulier les municipalit\u00e9s touristiques, il y a des r\u00e9sidences secondaires, des maisons qui n’ont jamais \u00e9t\u00e9 destin\u00e9es \u00e0 servir de r\u00e9sidences permanentes et qui, par cons\u00e9quent, ne peuvent jamais faire partie du probl\u00e8me du manque d’acc\u00e8s au droit \u00e0 un logement r\u00e9sidentiel.<\/p>\n

Notre cabinet d’avocats Lajares Law Offices conclut qu’il ne devrait pas y avoir de limites \u00e0 ce type de r\u00e9sidences secondaires pour mettre en \u0153uvre l’activit\u00e9 de r\u00e9sidences de vacances et la mairie peut emp\u00eacher son projet de r\u00e9glementer les limitations impos\u00e9es dans les zones touristiques et les r\u00e9sidences secondaires.<\/p>\n
