Tax implications of the sale
Capital Gains Tax
Capital gains tax is applied when you sell a property. The idea is that you pay tax on the profit you make. If you are a non-Spanish tax resident then you have four months from the date of completion to submit a tax declaration for Spanish Capital Gains Tax.The tax rate for Capital Gains Tax is 19% for non-Spanish tax residents.If you are a Spanish tax resident you must declare Capital Gains Tax on your annual tax declaration.
Tax on the increase in the Value of Urban Lands, commonly known as Plusvalia Tax
This is a local tax payable to the Town Hall based on the number of years you have owned the property and the increase in the value of the property since its last sale. This tax is payable within 30 days of completion of the sale.
Reclaim the Plusvalia Tax!
Despite the fact that the Law imposes on the sellers of a property to pay the Tax on the Increase in Value of Urban Lands, the last resolutions of the Supreme Court maintain that you are no obliged to pay this tax when there has been no capital gain from the sale.
