Tourist accommodation suspension for COVID-19, what about my holiday home?

A regulation has been published Order AND / 257/2020, of March 19th, which declares the suspension of the opening of tourist accommodation establishments, in accordance with article 10.6 of Royal Decree 463/2020, of March 14 , declaring the state of alert for the management of the health crisis situation caused by COVID-19 (BOE of March 19, 2020).

What about my holiday home?

This regulation suspends the opening to the public of all hotel, tourists and other short-term accommodations, campsites, caravan parks and other similar establishments, located in any part of the national territory. So you cannot accept any reservations during the period of state of alert (for now until April 12th). If your holiday home is not occupied, it must be closed.

If, for whatever reason, rental clients are still staying in your property and has not yet been able to return to their home country, you have to notify them about the measures and restrictions imposed by the Spanish authorities and you are not allowed to offer them any cleaning, laundry or other logistic services. Certain maintenance tasks are allowed, for example pool cleaning and gardening, in case they do not have any contact with the occupants and they take their precautions.

These measures are imposed until the end of the declaration of the state of alert and its possible extensions.

What about my taxes?

As you are not allowed to accept reservations, it is probably that your taxes will come out negative. In case that, based on reservations from January and February, y our quarterly declaration comes out to pay, the measures made public are:

• The delay of the payment of the tax debt corresponding to all those declarations settlements and self-assessments whose term of presentation and income ends from the date of entry into force of this Royal Decree-Law and until May 30, 2020 will be granted.
• The period will be six months
• No interest will be charge during the first three months of the deferment
